Area brewer part of group suing state over alcohol regulation

 

Granbury-based Revolver Brewing, along with two other local breweries are planning to sue the state over how alcohol is regulated.

Revolver, Petioles Brewing Co. of Dallas and Live Oak Brewing Co. of Austin have joined with the Libertarian-oriented Institute for Justice to file a lawsuit in state court that challenges a law that brewers say forces them to give funds related to their territorial rights to beer distributions, according the Institute for Justice.

The group held a press conference at Revolver on Wednesday. The Institute for Justice is a public interest law firm focused on property rights and economic liberty. Before 2013, distributors would pay brewers for the right to sell their beer in markets like Houston or Austin. But, according to the Institute for Justice, Texas has made it illegal for brewers to accept compensation for their distribution rights. Even worse, according to the organization, distributors can then sell those rights to other distributors and pocket the money. Officials from the Wholesale Beer Distributors of Texas could not be reached for comment.
