Last week, Billy Bob Barnett closed Big Beat Dallas, the live music and restaurant complex within the Toyota Music Factory in Irving.
On Wednesday, Irving Taxpayers Matter, a group that accuses the developers of defrauding taxpayers, filed suit to block the city from transferring tax dollars to the Ark Group of Cornelius, North Carolina.
The lawsuit claims Ark didn’t build enough parking for events and didn’t build the plaza as big or cover it as promised. The lawsuit was filed by Larry Friedman of Friedman and Feiger of Dallas. Friedman also represents Barnett.
The city of Irving and Ark say the concert area, the movie theater, and restaurants continue to be open.
In a statement Ark said: “The plaza and all work at the entertainment center has been approved by the City of Irving and is in full compliance with our City agreements. We adamantly deny the far- fetched allegations by Billy Bob Barnett’s group.
